This has been an issue for me with this storyline as well. Noah was raised by his mother up until about 1 year (story time). The dad and his family had no idea that Noah even existed until that point. But that did not stop them from completely taking over and trying to eliminate bio mom from the picture.
The reality is that if there has been no legal custody established, the mom could just bring the police and take Noah if she wanted. But we know she has a serious health issue, so she doesnt want to do that.
It is sad for Noah that he is losing his mother and his father is going to deprive him of having meaningful moments with her at the end of her life. These will be things that may possibly lead to regret and resentment when Noah gets older.

After today's episode. I will now officially revoke my MIn-ki is a loving father who cares about his child statement. More truth bombs come out about his real mindset about his son in his expositional conversation with GH in the stairwell. GH nailed him to the wall. MK was upset that GH and DS went to the hospital together and that DS is doing father things with the child and not MK. GH told him What she needed to hear from MK as a father was not all his concern about DS but his concerns about the child (How's the child feeling? What happened?
