Actor Kim Soo-hyun’s team has completely denied rumors of a romantic relationship with the late actress Kim Sae-ron, claiming that “all KakaoTalk conversations were fabricated.” With this, the dispute over the truth has entered a new legal phase.
According to attorney Ko Sang-rok, Kim’s legal representative, if the claim of “fabrication” proves true, the case would go far beyond a mere rumor — potentially developing into a “nationwide fraud incident” involving multiple criminal offenses.
Below are four key legal issues connected to this controversy.
1️⃣ If the KakaoTalk chats
were fabricated — what crimes could apply?
If Kim Soo-hyun’s side is correct and the KakaoTalk messages were indeed faked, this would not be a simple lie but a clear criminal act.
At least three major crimes could be established:
① Forgery of private documents (Article 231 of the Criminal Act):
In court, KakaoTalk messages are recognized as “documents proving facts.”
If, as attorney Ko alleges, “conversations between the deceased and another man were altered to make it seem they were sent by Kim Soo-hyun,” this constitutes a typical act of forgery.
If such fake messages were then made public — for example, through YouTube broadcasts — the charge of use of forged private documents (Article 234) would also apply.
Both offenses are punishable by up to five years in prison or a fine of up to 10 million KRW.
② Defamation by spreading false information:
If false information was spread online (such as via YouTube), it falls under Article 70(2) of the Act on Promotion of Information and Communications Network Utilization and Information Protection.
This crime requires an intent “to defame another person.” If forged evidence was used, such intent would be deemed clear.
The punishment is severe — up to seven years in prison or a fine of up to 50 million KRW — heavier than under the regular Criminal Act.
Attorney Ko even described this as an “unprecedented national fraud incident.”
If the forged evidence was used to raise donations or earn advertising revenue, fraud (Article 347) could also apply.
2️⃣ If the bereaved family was involved — can they avoid liability?
Another focal point of the controversy concerns the family of the late Kim Sae-ron.
Attorney Ko suggested that “CEO Kim Se-eui (of Garo Sero Institute) and the bereaved family may have deliberately edited or manipulated the materials,” directly raising suspicions of the family’s involvement.
If it turns out that the family participated in fabricating or distributing the fake messages, they could face joint principal offender (co-principal) liability under Article 30 of the Criminal Act.
If they knowingly cooperated — for instance, by approving or helping spread the forged chats — they could be punished as co-offenders for forgery and defamation.
Even if they did not directly participate but knowingly tolerated or assisted the crime, they could be charged as accessories (Article 32).
However, if they were deceived and genuinely believed the chats were real, they would lack criminal intent and thus avoid punishment.
Still, if there were clear signs of fabrication and they ignored them, implied intent could be recognized.
3️⃣ Kim Soo-hyun’s “fabrication” claim — risk of backlash
Kim Soo-hyun’s decision to claim fabrication is a double-edged sword.
If his claim proves false, it could backfire — exposing him to accusations of defaming Garo Sero Institute and the bereaved family (“reverse defamation”).
If attorney Ko’s statement that “CEO Kim Se-eui and the family may have intentionally manipulated the evidence” turns out false, it could constitute defamation by falsehood under the Information and Communications Network Act.
However, not all suspicion-raising constitutes defamation.
Attorney Ko supported his claim with specific grounds — for instance, that “based on Kim Soo-hyun’s official schedule, it was physically impossible for him to have exchanged those messages.”
Because his statements were based on objective reasoning and used cautious language like “there is a possibility,” and since he requested the opposing side to submit the full chat records to investigators, these actions may protect him legally.
Ultimately, the risk of backlash depends on whether Kim Soo-hyun’s team can objectively prove the alleged fabrication.
4️⃣ The remaining tasks to uncover the truth
Now, both sides’ claims are set to face legal scrutiny.
To prove their case, Kim Soo-hyun’s side must focus on establishing a solid alibi — showing, through official schedules or staff testimony, that he was filming or abroad at the time the alleged chats took place.
Another major variable is the “thousands of photos” Garo Sero Institute claimed to possess.
If such photos actually exist, they could deal a severe blow to Kim’s side.
However, if they ultimately fail to present them, the “fabrication theory” will gain greater credibility.
