불송치 (literally “not sending/referring”) is the police decision, after completing an investigation, not to forward the case to the prosecutors.

In the Kim Soo-hyun case, the police issued a “혐의없음” 불송치 (“no suspicion” non-referral). This is the strongest form of clearance among non-referral outcomes: the police determined there was no basis to recognize a violation of the Child Welfare Act.

The police’s “혐의없음” 불송치 decision means that after a full investigation of the Child Welfare Act allegations (including the period when Kim Sae-ron was under 18), they concluded the claims were not substantiated and closed the case without referring it for possible prosecution. Attorney Go’s statements in the article below emphasized that this was a definitive investigative conclusion on those specific allegations, separate from any ongoing trials involving the people who spread the claims.

Note: they went beyond the fake evidence to find out if KSH did, indeed, violate any Child Welfare Act laws - and found no such evidence.

It covered the entire period of the raised allegations, including the third year of high school, which people commonly regard as the minor period.”
He further stated: “The police investigated the claims and submitted materials from the other party as well as the relationship and relevant facts at the time, and concluded that there was no basis to recognize a Child Welfare Act violation by Mr. Kim Soo-hyun, deciding not to refer the case.”
Additionally: “A non-referral decision does not mean that judgment is being reserved or that the outcome of another future trial is being awaited. It is a disposition by the investigative agency concluding that the establishment of the crime cannot be recognized with respect to the relevant allegation and therefore not referring the case to the prosecution, thereby ending the investigation. Accordingly, the official conclusion reached by the investigative agency at present is clear: the allegation that Mr. Kim Soo-hyun dated the deceased while she was a child, or committed acts violating the Child Welfare Act such as sexual abuse, has not been recognized.”
He also noted: “The upcoming criminal trials of Kim Se-ui and related parties are not trials to determine whether Mr. Kim Soo-hyun violated the Child Welfare Act. They are trials to determine whether they spread false information or used fabricated materials and what crimes they committed in the process. Mr. Kim Soo-hyun’s minor-related allegations are not a legally unresolved matter that will only be concluded in a future trial. Those allegations have already been independently investigated and closed with a ‘no suspicion’ non-referral decision.”

This has been investigated every which-way to Sunday. There is no evidence he did anything wrong. Not because he’s a celebrity or because he’s rich. But because the authorities did their job. If you have more proof, bring it. I’m sure the authorities will be happy to have it. If not then stay silent about the accusations. Why didn’t KSR’s family release her phone? Could it be because there was other evidence on it, not related to KSH, that would have made them liars? If they were so intent on bringing justice for their daughter, they would have willingly given up her phone to the authorities. There are so many unanswered questions on the family’s end. But the haters have it all figured out on KSH’s end, even better than the investors.

Again, that heinous, very serious accusation must come with irrefutable evidence, of which there is NONE. If there is no evidence, then your post is defamation. Pure and simple.

Just to add…., Because of his ability to hire the legal team he hired, other innocent celebrities who fall victim to cyberbullying can thank him for exposing cyber defamation for what it is. The law is changing due to this case - thanks to kSH’s legal team. High-profile, innocent victims can fight back now, too, and not leave their industry or make the extreme choice so many others have made before them because they didn’t have the ability to fight back.

Someone correct me if I’m wrong but I’m sure I read that once the investigation determined the evidence brought to them was fake, they went several steps farther. They concentrated on both KSH & KSR’s timelines and any other verifiable evidence (digital or non-digital) there was from her minor years in order to independently determine if KSH actually had a relationship with her while she was a minor. They found no evidence, independent of the fake evidence, to support the accusations. I can’t find that article but I read it in the last couple of weeks.
