Any defense attorney would've thrown it out. There were witnesses who saw both men drinking. It would simply be seen that the costars drank, went back to the hotel and had fun. Jin had to go off his nut because Akin wouldn't tell him anything. I get that Akin was frozen about the assault. He was confused too. Jin used his way to confirm what actually happened, obtained blackmail material from John AND with that info, he helped exonerate Akin's huge guilt. Because that guilt was Akin's major problem. Jin wasn't supporting the assault, he needed to show Akin that he shouldn't feel bad. And that's why Akin was immediately relieved.

Of course if you're drunk and this happens to you, you should report to the authorities. You shouldn't blame yourself like Akin had. It wasn't your fault.

Let me explain what someone up there already did. Akin thought he'd been assaulted. He thought it was his fault. But most of all, he thought he'd betrayed a man he loved. And this guilt ate at him. Which is why he got out of the car. Why he returned the necklace and tried to break up. Jin's "you didn't do anything wrong" was to exonerate the GUILT, not the assault. Nor to diminish it. I mean he incited Johnny to confess something heinous because he felt it was wrong.

And that's also why he went to Johnny himself to find out exactly what happened. And with that knowledge, he helped Akin. Didn't you see how relieved Akin was immediately?

It wasn't 'banalized' Even if they went legal, do you know how hard it'll be to prove? given that witnesses saw both of them drinking?
