well you are technically right. BUT the thing is that the younger brother didn't know before. the older brother didn't directly tell him (when conscious) that he was alright with doing it. thousands of people are watching this and there could be someone in the same situation. they could end up raping another person.
I know this is not a show for educating but I hope you get my point that having sex with someone without their absolute awareness is rape and should not be taken lightly.

yes I hope so too... there should be some limits to fantasy too. you can't fight logic and normalize mental disorders. the relation between the step brothers is not illegal. there are weirder preferences. but the younger brother's action has problems.

agreed. if you have read a lot of yaoi mangas you should know that what they are portraying here is cheap yaoi logic XD. I can kinda forgive it if it is a manga but for movies, no no. as you said it makes it a soup opera with not really well thought characters.
