Yes, you have pointed out several very frustrating plot holes. The police have the dash cam footage and should have already reviewed it and determined that Jang Mi's dad was not hit, but run over. Also, they should have impounded the vehicle or at least inspected it for dents. They should also know by now that the lighting in that area was not good at all. The driver turned himself in, was not drunk, and is cooperating. They have no actual evidence to charge him with anything.
