Misconduct? Yes. Harassment? No, not every case; both cases you mentioned were consensual. Generally, these cases are handled by the HR, not by a dedicated ‘investigation department’, unless this is something that happens on the daily.

We see the ML going out of office hours trying to dig up dirt on the FL. If we're talking about 'reality' as you mentioned, then this is clearly a breach of privacy, a very serious breach, as we saw by the end of the episode.

Even if an affair, why does the company have a separate department to investigate a personal relationship of two consenting adults? I can understand if one party is not consenting and the other forces themselves on the first; but why investigate when both parties consent?
