Legally yes it is sexual harassment. In workplace, the guy needs to discipline her on record and involve HR immediately to avoid claims of abuse of power. But since all her actions are off the record and the complainant will be the only witness as well as the complainant and direct supervisor, if she chooses to deny the allegations in a show cause meeting, the company is in a bind. These compliance investigations are tricky AF. But it’s grounds for immediate termination post investigation. But the boss has made the situation even more complicated by letting her stay at his privately owned real estate.
