Does that even matter in the court of public opinion? Did Prada wait for a verdict? How about the other 1-2 dozen brands who dropped KSH?

Is this what's keeping Knock Off on the bubble? Do you presume Disney is keeping the show on hold pending the outcome of a court trial?

Court filings are public documents and all will be clear in another day or so. I think you may very well be correct, but ambiguity remains. GM/KSH's lawyer said they filed both a criminal complaint and a civil lawsuit. I am waiting to read the charges from both and until then I can only assume the 12b krw damages are associated with the criminal complaint, but it could be the civil one. (Less likely but also possible is the amount being split between them.)

Also, keep in mind that any defamation lawsuit invites discovery!
