Just as a warning, that drama is a different genre entirely - a grim suspensful detective drama with romance as a sub-plot. May not be everyone's cup of tea. But FL totally nailed it there.

I'm not defending anything. The drama gave reasonable, historically accurate explanations why she was pardoned. And she's not the real villain of that case, her friend was and those mysoginistic healers who plotted plots instead of promptly healing people.
That other case you've mentioned is another story entirely. Women are doing this even to this day, they're called surrogate mothers, it's not a crime, just business. And if there's a family full of starving bellies counting on the money you'd make by any means, you wouldn't judge these women so harshly. No social security back then. And again, these women were not the real villains of that case, people who exploited them were. The minister there voiced your concerns exactly. You can blame the final decision on the emperor. It's not the first time in the drama he makes questionable decisions. Though here I'd say I agree with him. She only figured out a cure with very expensive ingridients and poor people still were waiting on it. The disease was still not eradicated and talented healers were in dire need. That emperor was always thinking of the bigger picture, instead of simply following the law to the letter.
And it wouldn't be out of the blue in any case. In ancient China major criminal offenses' punishments were sometimes changed to forced atonement labor. That's how many eunuchs ended up working at imperial palaces, for example.
